The first legal step a creditor can make to recover a debt is to apply to the court for a CCJ. If granted, the debtor will be ordered to pay the debt by a specific date. To defend the claim, the debtor must file an ‘acknowledgement of service’ form. If no defence is filed, the claimant can complete and file a ‘request for judgment’ form for the court to order a judgment in default.
